Course Description

This course introduces civil aviation law, with a focus on Indian law. It is structured to address the first principles of aviation law, followed by in-depth explorations of airline regulation, aerodrome governance, domestic disputes, international conflicts, and other key areas. The course, which covers both academic and regulatory perspectives, will guide students in applying theoretical underpinnings to practical aspects. Students will design and develop guidelines, negotiate international arrangements, participate in mock administrative proceedings, and draft agreements as part of an in-class exercise during the course.

Aviation law is unique due to international cooperation and the harmonisation of industrial practices. Cooperation and harmony do not eliminate existing conflicts. The course offered combines public and private law. Special rules and contracts are standard in the aviation industry, and this course provides an opportunity to engage with them.

Air Navigation; Air Traffic Services; Meteorological Information and Satellite Imagery; Airport Business; Airport Ownership; Privatisation of Airport; Airports Economic Regulatory Authority of India; Aerodrome responsibility; Ground Handling; Retail Outlets; International frontiers and taxation; Aviation and its impact on Environment; Safety and Security in Aviation; Artificial Intelligence, Automation of Air Traffic Services, and Passenger Identification and Privacy; and Dispute Resolution in Aviation.

Students will demonstrate a comprehensive understanding of aviation law principles and their application in various situations.

Pedagogy: This course is designed around the Socratic method of discussion. Students will anchor discussions and participate in class discussions and case law analysis.
