Research Seminar Course – Full Term Elective

Approach: This seminar course aims to explore the subject of corporate insolvency law in India in detail. Firstly, the course will engage in the understanding of the design and working of the Insolvency and Bankruptcy Code, 2016 (Part II processes) (“IBC”). This will be followed by an intensive study of the fundamental segments of IBC and the regulatory framework concerning corporate insolvency, through ten modules. Post this, the challenges and potential solutions for the issues arising in each module will be analyzed.

Materials: The principal sources used for the course will be analysis of primary sources – legislation, regulation, preparatory materials and caselaw. Core legal texts are added as recommended reading for further guidance on concepts and caselaw.

Pedagogical method: Lectures and seminar style discussion. Students will be asked to submit a Seminar Paper at the end of the course.
