Call for Applications | Research Associate – Dynamics of Formal and Informal Constitutionalism

May 14, 2026

The National Law School of India University (NLSIU) invites applications for one Research Associate to work on the project titled ‘Dynamics of Formal and Informal Constitutionalism: Mapping the Formation, Functioning, and Adjudication of Constitutional Conventions in India’. The position is for 18 months and will be based in Bengaluru.

The project is funded by the Indian Council for Social Science Research (ICSSR), Ministry of Education, Government of India.

About the Project

The project aims to examine the dynamics of formal and informal constitutionalism in India, with a particular focus on the formation, functioning, and adjudication of constitutional conventions. It argues that the prolix nature of the Constitution of India does not negate the institutionalisation of informal constitutional practices. Moving beyond traditional common-law frameworks and the Jennings test, the study adopts a post-colonial perspective to analyse how constitutional conventions evolve, operate, and influence governance. It further explores their role in addressing constitutional silences, shaping institutional interactions, and contributing to constitutional culture. The project will undertake the following key activities:

  • Study of constitutional conventions as part of informal constitutionalism
  • Examination of post-colonial evolution of conventions in India
  • Critically analyse formation, functioning, and adjudication of conventions
  • Develop an empirical mapping framework linking constitutional provisions and conventions
  • Identify alternatives to the Jennings test
  • Examine legitimacy and justification in a post-colonial context

Prof. (Dr.) Sanjay Jain, Professor of Law, NLSIU will be the Project Director for this ICSSR funded project.
