On 1 May 2023, the Supreme Court of India issued an order seeking to recall its own decision in Ritu Chhabaria vs Union of India upon the insistence of the Solicitor-General of India, Tushar Mehta. Besides the questionable legality of the Court ‘recalling’ its own decision, the court’s decision has implications for the fundamental principles of criminal procedure.
