National Law School Trilegal International Arbitration Moot and Conference | May 2024

The Moot Court Society at NLSIU will host Edition XVII of the National Law School Trilegal International Arbitration Moot (NLSTIAM) for 2023-24. The competition will be held offline in Bengaluru from May 17 to 19, 2024. It will also host Edition V of the National Law School Trilegal International Arbitration Conference (NLSTIAC) on May 18, 2024.

Edition XVII of NLSTIAM

The National Law School-Trilegal International Arbitration Moot is the National Law School of India University’s flagship event on international arbitration and commercial law. As India’s largest arbitration moot, the competition is abundantly marked by diverse areas of arbitral law and even more variegated perspectives on the same. Our wide participation base only serves to exemplify differences in jurisprudential values vis-a-vis arbitral law. In addition to the assorted participants, the MCS has engaged arbitrators at the top of their fields from national and international platforms in the past. These include Mr. Steven Finzio, Honourable Retd. Justice BN Srikrishna, and many others. This year is no exception as​ the MCS prepares to welcome Mr. Gary Bell, Honourable Justice Riyaz Igbal Chagla, and many alike. Additionally, the problem for this year’s edition has been meticulously crafted by experienced arbitrators at the Singapore International Arbitration Centre.  In line with the stakes, which include large cash prizes, we shall also be conducting the Semis and Finals Rounds at the Conrad in Bengaluru.

Senior Advocate and Leading Mediator Mr. Sriram Panchu Delivers Talk at NLSIU

We were delighted to host Senior Advocate and expert mediator Mr. Sriram Panchu at the NLS campus on May 2, 2024, where he delivered a guest lecture on the topic “Mediation in India – Development, Legislation and Prospects”.

Mr. Panchu has been at the forefront of the Indian mediation movement and played an instrumental role in setting up India’s first court-annexed mediation centre at the Madras High Court. Mr. Panchu has been appointed as a mediator in several  prominent commercial and public disputes. Mr. Panchu’s practice also extends to corporate law, commercial matters, and family disputes, among other areas. Mr. Panchu has also published in India as well as abroad, and has several books to his credit.

He addressed the third year students from the 5-Year B.A., LL.B. (Hons.) programme, currently studying the Alternative Dispute Resolution (ADR) core course. During his lecture, Mr. Panchu, spoke about the developments in the field of mediation and its prospects, and he also covered legislation, alongside sharing some of his personal experiences as a mediator in the field. He  later interacted with students and staff, on mediation as well his other areas of practice, after the lecture.

On his visits to NLS: “I liked the classroom session with the NLS students. I thought their level of interest was good, and the questions were excellent! I recall visiting the campus during NLSIU’s 25th anniversary celebrations and had met with NLS Founder-Director Dr. Madhav Menon at that time. I have visited the University a couple of times since then including seminars and so on.

I am currently in the process of developing lectures on specific themes (such as ‘the great judges of all times, the great cases, and the great legal doctrines’), and would be happy to engage with NLSIU in the future on this series. This lecture series will also be made available on my website (linked below).”

Advice for students who want to pursue interests in mediation: “Students who are interested in pursuing a career in mediation should continue to engage with it. They should do a training programme that doesn’t take too much time. They should continue to read, there is a lot of good reading material, and when they have the opportunity they should intern with somebody who does mediation work, so that they can gauge their own interest and see how much they like it. I have also been telling youngsters who came to see me that whatever field of law you may want to do, you may do that, but you can also practice Mediation. If you have a yen for mediation, you can of course mediate whenever you have the time. There is that flexibility. If you decide you want to focus more on mediation, you can do that too. But keep in touch with it because it is growing. It is at a take off stage. Things have to be done for it to really move. Once it moves, it will be a different ball game. So just continue your engagement with it.

On the topic of mediation itself, there are a lot of things (conversations, articles) out in the media, social media etc. You will have to be careful, but you must learn to identify sources that you can trust. So when you are watching something, you must ask the question ‘Is this a reliable source?’. The automatic reaction is to open it and read it and think it’s genuine. I think today, we have to ask ourselves the question, “Is this a reliable source?’’.

NLS Faculty Dr. Sushmita Pati’s Book Wins the 2024 BASAS Book Prize

We congratulate NLSIU faculty member Dr. Sushmita Pati who was awarded the 2024 BASAS Book Prize for her book Properties of Rent: Community, Capital and Politics in Globalising Delhi!

The BASAS Book Prize panel for 2022 publications had an excellent field of books to evaluate. Ultimately the Book Prize panel were unanimous about the decision to award the prize jointly to two very worthy winners for their outstanding scholarship: Olly Akkerman for A Neo-Fatimid Treasury of Books: Arabic Manuscripts among the Alawi Bohras of South Asia (Paul Mellon Centre, 2022) and Sushmita Pati, Properties of Rent: Community, Capital and Politics in Globalising Delhi (Cambridge UP, 2022).

Call for Papers | Pluralist Agreement and Constitutional Transformation (PACT) – NLSIU Conference 2024

The National Law School of India University (NLSIU) will host a conference on August 1st to 3rd 2024 in Bengaluru as part of the Pluralist Agreement and Constitutional Transformation (PACT) Project. PACT is an international collaboration, that aims to produce cutting-edge scholarship on India’s constitutional founding, establish a new digital archive on Indian constitution making, and learn from historical and contemporary public engagements with the Constitution. Led by SOAS University of London, PACT collaborators include the Universities of Oxford, York, the Centre for Law and Policy Research, Bengaluru and NLSIU.

Theme

The conference will explore Indian constitution-making as a process of reaching pluralist agreement between contending actors and constitutional transformation over time, through three lines of enquiry.

  • First, what were the types of counter-majoritarian proposals put forward by advocates of individual freedoms and group rights in India between 1928-50? What were the constitutional alternatives offered by those outside the Constituent Assembly?
  • Second, what was the relationship between the procedures adopted in the Indian Constituent Assembly’s deliberations, and its outcomes with regard to pluralism? How did the division of the Assembly’s work into various committees, decision making processes and the timing and sequencing of proposals enable or hinder the accommodation of diversity?
  • Third, what forms of participation and civic engagement are enabled by the extensive constitutional archive available today? In what ways is this archive used to bolster contemporary appeals to constitutional values and principles?

We invite paper proposals that engage with the above themes, particularly those that explore the role of marginalized communities in the making of the Constitution. This could mean looking outside the confines of the Indian Constituent Assembly to include a range of voices that are absent from, or marginal in, the official records. PACT understands the marginalized as defined in diverse ways, spanning identities of gender, caste, religion, tribe, class and more.

  • Deadline for abstract submission is June 25, 2024. Abstracts will be reviewed on a rolling basis.
  • The abstracts will be reviewed, and invitations will be sent from May 20, 2024.
  • Final drafts must be between 5000-8000 words and must be submitted by July 15, 2024 to enable discussants to respond to papers.

Mode

The conference will be held in person at the National Law School of India University, Bengaluru. The University will provide local accommodation and meals to all participants.

Call for Applications | Research Associate (two positions) | Exploring Digital Transformation of India’s Consumer Grievance Redressal System through GenAI

NLSIU invites applications for two Research Associate positions under the Project on “Exploring Digital Transformation of India’s Consumer Grievance Redressal System through GenAI”. This is a full-time contractual assignment (12 months) based out of NLSIU campus in Bangalore.

About the Project

NLSIU is implementing a research project on Digital Transformation of India’s Consumer Grievance Redressal System through GenAI. The project seeks to assess how large language models (LLM) can be used for building public solutions for enhancing efficiency in India’s consumer grievance redressal system. The project is being  executed along with the Indian Institute of Technology Bombay (IIT Bombay), in collaboration with the Department Of Consumer Affairs (DoCA), Government of India, as the knowledge partner. The project is being supported by a generous donation from Facebook India Online Services Private Limited, an affiliate of Meta Platforms Inc.

The project will explore the feasibility of leveraging Llama 2, Meta’s openly available large language model, in creating and evaluating a proof of concept of a citizen-centric chatbot and a decision-assist tool in the area of consumer law. With the goal of enhancing efficiency, the chatbot will be designed to guide consumers on the procedural aspects of drafting a complaint and answering questions relating to consumer law in India. The decision assist tool in this research also will be designed to support searching case laws and summarisation of documents to provide assistance to judicial authorities in the area of consumer affairs. The research project will explore how LLMs can assist consumers or judicial authorities in the context of ongoing oversight and control by human decision-makers. In keeping with the commitment to responsible innovation, NLSIU and IIT Bombay will also release a white paper explaining the risk mitigation approaches implemented and how responsible design principles have been deployed at every layer of the stack.

Role Description

The Research Associate will:

  1. Assist the Project Co-Investigator and other team members in conducting literature reviews, and curating relevant cases and materials.
  2. Research on contemporary themes and writing blog notes, academic papers and research
    reports in the areas of consumer law as well as AI and the Law.
  3. Conduct field and desk research on consumer procedure including conducting the Consumer Needs Survey and administering the AIAssist Experiment.
  4. Participate in project meetings and collaborate with the team from IIT Bombay and DoCA.
  5. Testing and giving feedback on applications developed re including conducting the Consumer Needs Survey and administering the AIAssist Experiment by IIT Bombay.
  6. Cleaning, coding and analysing data obtained from surveys, experiments and other public sources.
  7. Creating a training corpus on consumer law for building AI applications.
  8. Managing and Supervising the work of research interns.
  9. Organising and conducting workshops and conferences.
  10. Preparing progress reports and or managing other reporting needs.
  11. Timely completion of  administrative responsibilities under the project

The Research Associate will work under the supervision of the Co-Investigators.

Qualifications

Essential:

  • Bachelor’s Degree in Law/ related discipline from a recognised University.

Desirable:

  • Candidates with a Master’s degree and relevant working experience will be preferred.
  • Candidates who have a background in technology and experience in undertaking law and technology research will be preferred.

NLSIU Launches Visiting Scholars Programme

About the Programme

The Visiting Scholars Programme at NLSIU welcomes exceptional international scholars and practitioners engaged in research across law and social sciences. The programme extends to those holding a rank of Professor/Associate Professor/Assistant Professor/Doctoral/Post Doctoral Candidate in their home university. The aim of the programme is to enable collaborative scholarship and promote a culture of knowledge sharing across disciplines. Visiting Scholars conduct their research in collaboration with or support of the NLSIU faculty members, and participate in the broader intellectual life at NLSIU, when required.

Visiting Scholars are hosted as guests of NLSIU for a pre-defined duration i.e., from three months to a year. Scholars will not be entitled to remuneration/honorarium or housing during their visit. They will have access to University facilities (e.g. Library) and office space, subject to availability.

The Visiting Scholars Programme is anchored by the Office of Dean Research. Applicants to the programme must be referred by a faculty member who is willing to act as an advisor to the proposed research. It is the responsibility of a prospective Visiting Scholar to contact appropriate faculty members in advance to support their application.

Scope of Affiliation

In addition to pursuing their own research objectives while at NLSIU, Visiting Scholars are invited to actively participate in other University activities, such as:

  1. Delivering a formal lecture at the University.
  2. Participating in faculty and research seminars.
  3. Engaging in formal or informal discussions with students.
  4. Undertaking collaborative research with faculty or staff.
  5. Presenting guest lectures in classes.

As non-employees, Visiting Scholars will not be given full-time teaching responsibilities but may be invited for guest lectures.

What is expected of a department or faculty member hosting a Visiting Scholar?

The relationship between a Visiting Scholar and an NLSIU faculty referee can range from occasional oversight to close collaboration. It is important that the nature and scope of the relationship, as well as the specifics of the prospective Visiting Scholar’s research project, be worked out by the two before the visiting scholar arrives at NLSIU.

Call for Applications | Research Assistant | Centre for Labour Studies

NLSIU invites applications for the position of Research Assistant under the Centre for Labour Studies for the specific purpose of assisting in preparing a draft labour policy for Karnataka. This is a full-time contractual assignment (at least 6 months) based out of NLSIU campus in Bangalore.

The Centre for Labour Studies (CLS) is an interdisciplinary research centre at NLSIU. It engages with holistic labour jurisprudence for the entire workforce of 500 million with special focus on the deprivation of standards for the informal workers of India who constitute 90 per cent of the workforce. The centre focuses on issues of policy and law reform, including the drafting of new laws. Its value goals derive from our constitutional goals along with Core Labour Standards of the ILO. It seeks to actualise minimum wages and fair wages and a floor level of labour rights for all, along with decent conditions at work.

CLS is presently engaged in drafting an umbrella legislation for the informal workforce of India and on special laws relating to platform-based gig workers, migrant labour, contract labour, home based workers and agricultural labour. Specifically, it is playing a leading role in the tripartite exercise of drafting a Labour Policy for the Government of Karnataka.

Role Description

The Research Assistant will:

  1. Summarise international and national standards, norms, guidelines pertaining to labour conditions to be observed by industries, governments, and trade unions.
  2. Collate and review existing evidence-based research documenting issues facing different segments of industry in Karnataka.
  3. Document and produce timebound reports with focus on expected outcomes and relevant follow up.
  4. Maintain steady liaison and continuing contact with all stakeholders identified for tasks from time to time.
  5. Carry out research which adds value to contemporary issues of labour that arise during meetings with informal workers, employers’ associations and their organisations and share such outcomes.
  6. Liaison with the communication department of NLSIU for enhanced visibility of ongoing labour research and related outcomes.

The Research Assistant will work under the supervision of Prof Babu Mathew, Co-Director, CLS.

Qualifications

Essential:

  • Master’s degree in law and/or social sciences from a recognized university OR five year LL.B degree with field work experience in legal activism.
  • Demonstrable academic interest and experience in the field of labour law pertaining to non-standard forms of employment (informal workers, etc).

Desirable:

  • Fluency in Kannada including writing, reading, and speaking.
  • Knowledge of legal and policy standards pertaining to labour law in India and globally.
  • Research and/or practical experience on issues affecting workers in the unorganised sector and daily wage labourers.

Reliance Chair on Corporate Law Governance | Reading Group on Critical Corporate Law

The Reliance Chair on Corporate Law Governance at NLSIU, invites expressions of interest from students to join a reading group on Critical Corporate Law.

About the Reading Group

The objective of constituting and supporting the reading group is to popularise critical approaches to corporate law, and to engage students in contextualising corporate law within the contemporary political economy. As a group, which will be anchored by the students, members will read and discuss a single text book on contemporary Law and Political Economy over at least 6 meetings spread across a trimester. The choice of the text book will be based on majority votes of members on a list of nominations. The first two nominations, to be finalised soon, are: a) Thomas Piketty, Capital in the Twenty First Century (2014); and (b) Katharina Pistor, The Code of Capital (2019).

In holding discussions, the group will read and share their views on the book, and draw connections (in their discretion) with the doctrinal corporate law currently in force. The discussions of the group, in reading the text, may encourage members to write short articles in a blog format either in collaboration or by themselves. The Chair will coordinate with the student led NLS Journal of Business Law and support the publications of these blogs on the website of the journal, subject to its approval by the editorial board.

Depending on the tenor of the discussions during the group meetings, the frequency of such meetings, and the topics, the Chair will also facilitate inviting external members with interest in relevant topics to join the group.

Who can Apply?

Students from the following batches can apply to join the reading group:

i) 5-Year B.A., LL.B. (Hons.) – 3rd year onwards
ii) 3-Year LL.B. (Hons.) – all batches
iii) LLM

**Please note that the the spots are limited to 4 students from each batch. In case of applications exceeding that number, those students with a clearer expression of motivation who have applied earlier, will be prioritized.
