This is a seminar to explore the nature of constitutional argument and interpretation in India, and
understand what makes a valid constitutional argument or proposition. We will be studying Philip
Bobbitt’s modalities of constitutional argument – text, history, structure, doctrine, prudence, ethos. –
through the Indian constitutional experience. We will also attempt to understand the importance of
the modalities and aim to explore whether these modalities can be determinative of particular
outcomes in constitutional law.
