NLSIU Team Wins the NUJS-HSF Moot 2023!

We are happy to share that the team from NLSIU has won the 15th edition of the NUJS-Herbert Smith Freehills National Corporate Law Moot Court Competition 2023! The Competition was held at the West Bengal National University of Juridical Sciences, Kolkata.

This year’s moot proposition revolved around three main issues:

  • The first issue dealt with the maintainability of shareholder derivative actions in India.
  • The second revolved around director’s duties under section 166 of the Companies Act 2013 with respect to dividend declaration and the non-enactment of a climate policy.
  • The third issue was related to the conclusiveness of a foreign judgment in India under the Civil Procedure Code 1908.

On what helped the team succeed:

We believe that setting up internal deadlines well in advance, constant meetings every couple of days, spending at least a week on formatting our memorials, and giving a decent number of practice rounds benefitted us vis-à-vis the other teams in the competition. We had a significant edge in terms of teamwork, pre-empting potential questions, and being consistent through the course of our rounds. This also ensured that we could balance our moot preparation with academics and end-term exams, which were right after our oral rounds. The moot served as great exposure to various corporate law issues and was a wonderful experience for the entire team.

We would like to thank our faculty Mr. Rahul Singh, our coaches, Vidisha Singh and Rajat Maloo among other seniors for their invaluable guidance and assistance throughout the course of our competition. It was an honor to argue before legal luminaries such as Justice Shampa Sarkar, V Niranjan, and Chris Parsons. We were elated to lift the trophy that had singularly occupied our minds for the past few weeks.
