INTRODUCTION

The study of the law encompasses both the substantive and procedural aspects, which are essential for enforcing the rights of individuals. The Litigation Advocacy Clinical Course deals with the skills and strategy aspects for accessing the rights. Though the skills required to handle litigation are usually learnt while addressing real situation in Court, it would amount to experimentation on the miseries of litigants. In order to reduce the chances of such an eventuality, the course on Litigation Advocacy aims at introducing the students to the basic skills required while applying the substantive and procedural laws to practice and hence is a core subject.

COURSE OBJECTIVE

Briefly stated, the Course has the following objectives:

  • To initiate the students to the basic skills required to handle trial cases (as the procedural laws – CPC, CrPC and the Evidence Act applies to all kinds of litigation) and the skills required to handle writ and appellate proceedings.
  • To introduce the skills of client interviewing and counseling in the context of the information required to redress the grievance.
  • To introduce the students to the skills of drafting pleadings and applications to be filed before Courts/Tribunals.
  • To initiate the students to the skills of examination-in-chief and cross-examination.
  • To expose the students to the art of advancing arguments on the basis of the pleadings and evidence on record.
  • To introduce the students to the process of drafting appeals, filing them and advancing arguments.
