This course, ‘International and Comparative Law of Patents’, has been designed for candidates who have exposure to the basics of Intellectual Property Rights. Study of Law of Patents from an International and Comparative perspective gives a comprehensive picture of the philosophy underlying Patent regime as well as the complexities involved in its acquisition and protection. The course gives candidates an exposure to evolution & rationale of Patent system, International instruments regulating to its protection, Included and excluded subject matter entitled for protection, mode of acquisition of those rights, practical exposure to prosecution of patent application, rights of the patentee, violation of the rights of the Patentee, tests for determining infringement of the Patent, Defenses in public interest in case of infringement, Interface with standards, competition law and public health.

The course will be delivered by lecture-cum-presentation method, requiring the candidates to read the relevant portion of study materials and the assigned articles/ cases prior to their classes and participate actively in the discussion. The candidates to whom they are assigned shall make Case/ article presentation. Relevant articles and Cases will be sent electronically to all candidates periodically
